Rule R430-90-6(10):08:
If a fence is required in Subsections (3), (4) or (9)(b), there shall be no gap greater than five inches in the fence, nor shall any gap between the bottom of the fence and the ground be greater than five inches.

Findings:
The fence that surrounds the play area has gaps greater than 5 inches x 5 inches at the bottom on the southside of the fence. This rule must be in compliance by September 23, 2010. If this rule is not in compliance by September 23, 2010, a civil money penalty of $100.00 will be assessed.
